And threatening to spread to the rest of the country.

Why is this happening?
Exhibit A:
Assembly Bill 5 or AB5, as it’s commonly known.
Passed by the California legislature in September of 2019, AB5 was authored by a former union boss Assemblywoman Lorena Gonzalez. The stated goal was to protect freelance workers from employers taking advantage of them. Instead, it has pushed thousands of these workers into the unemployment line.
Here’s why:
Workers in the United States are classified as either employees or independent contractors, sometimes known as freelancers.
Independent contractors are self-employed and contract their labor to one or more firms. The upsides to this arrangement are clear: Freelancers decide whom they work for, when, where, and how. They are their own boss.
So, then, what are employees?
Employees typically work for one employer. In exchange, they are entitled to workplace benefits and protections that independent contractors are not - such as healthcare, time off, minimum wage, and unemployment insurance.
We don’t have to agree which kind of employment is better. Different people have different preferences. It’s called choice.
But some people - specifically, unions and progressive politicians-are anti-choice.
AB5’s author Assemblywomen Gonzalez disdains freelance work. “These were never good jobs,” she says.
Oh really?
She might want to talk to some of the 2 million Californians or the 57 million Americans who freelance. 46% of those workers happen to be women.
Of course, the AB5 supporters would say the law is needed because companies, especially gig economy firms such as Uber and Lyft, willfully misclassify workers as freelancers to avoid providing benefits.
Why not ask the workers themselves?
Well, pollsters have.
According to a McKinsey study, nearly 80% of gig workers say they’re happier than those working traditional jobs. They love their freedom and also earn a good living. In fact, over 17 million freelancers quit their traditional job to freelance and two out of three of them say they earn more now than before.
For the majority, their new incomes outpaced their previous salary within just one year.

Half of the freelancers say they would not take a traditional job no matter how much they were offered.
And, in a survey of female gig workers, nearly two out of three women who have a side job prefer being independent contractors over being employees.
AB5 has already done damage. It has wiped out the livelihoods of many independent contractors and will limit new opportunities in the future.
Freelance writers and journalists have been especially hurt. The law includes a provision making it illegal for them to produce more than 35 pieces of content in a year for a single company.
Left-leaning Vox Media hailed the bill’s passage as “a victory for workers everywhere” then turned around and laid off 200 freelance writers rather than make them full-time employees.
The ride-sharing industry estimates that AB5 will increase their labor costs by 20-30%. As a result, rideshare companies may schedule drivers in advance and reduce the number of drivers during slow hours or in less busy markets. For customers, this means longer wait times, fewer available rides, and higher prices. For drivers, it means reduced flexibility and reduced income. It may also kill hundreds of thousands of jobs.

I agree with you that 99designs offer a not so good deal for designers. But don't you think that it should be the designers who decide if it's is a bad deal or not based on their own situation? For some it might make sense. Also I do agree with enforcing the over 18 part and not allowing non-americans to work for american companies. Without that last one American companies will be able to get labor of foreigners without a work visa.

I walk the line between the left and right, and I'm usually in favor of unions, but this isn't right. It's true that freelance workers don't get the same benefits as traditional employees, but many of them don't want those benefits in the first place. This seems less like trying to protect the rights of freelancers and more about muscling out competition, making the unions no better than the corporations they claim to fight against.

So if we protect freelancers from being exploited they will lose their jobs so we should do nothing to protect them at all? If that is the argument don't sugarcoat it like it is a good phenomenon that employers have so much power you cannot even try to protect workers from exploitation without causing them to lose their jobs. Hasn't it become the standard model for many media-related companies to exclusively hire independent contractors for limited times so as to completely bypass employment benefits? What do employment laws exist again for? To protect only a certain type of workers so that companies can exploit that distinction to hire workers that are not protected by that law? It does not follow that the benefits of being an independent contractor ought to be "paid" for through a lack of employment benefits. The two are not mutually exclusive in any way. There is no reason why such human imposed opportunity costs should exist for independent contractors.

I've never given a thumbs down to a PragerU vid, but I do it because it's not clear about what the bill actually does. It's a big hole in a video on an excellent topic. I don't disagree with anything stated but it fails to educate the viewer about the bill. 20 seconds of explanation would plug the hole. Maybe add back footage that was edited out?

The lack of these idiotic policies have given America an edge which led it to become and remain the largest economy in the world and a fantastic place for entrepreneurship. Dear Ms. Pratrica Owukaa, I recognize your concerns about legislative actions that harm jobs whether it is from the National or the local government. However, there are statements that I want to add clarification along with questions to ask. For instance, I want to add clarification to your statement, “The law includes a provision making it illegal for them to produce more than 35 pieces of content in a year for a single company.” (Owukaa) I researched your statement and found that there are changes in the law AB5 that the State/Province of California has passed. For instance, according to Investopedia, “Among those exempted from the strictures are still and video photographers and editors, freelance writers, content contributors, editors, translators, fine artists, and musicians. One key change was the removal of caps for categories of freelancers that had limited the number of contributions they could make to an outlet, such as a website, without having to be reclassified as employees.” (Lake) Additionally I have some questions about your statements. For instance, I have a question about your statements about AB5 causing unemployment among Freelancers when you said, “AB5 has already done damage. It has wiped out the livelihoods of many independent contractors and will limit new opportunities in the future.” (Owukaa) How much of the hurt job opportunities and unemployment among the freelancers was caused by AB5 and/or by the COVID19 virus? Because the timing of the passing of AB5 in September of 2019 happened right before the COVID19 pandemic started. For example, according to Poynter.org, there was the case of a freelancer named Monica Castillo who was a movie/art/culture critic freelancer who had plans for other film festivals across the country especially the Cannes film festival. However, when the COVID19 virus hit the United States the movie theaters were closed. Usually, under normal circumstances, a freelancer would take odd jobs to earn extra income such as being a movie theater usher or a waiter/waitress. But due to the COVID19 virus also causing many restaurants and other ”nonessential” businesses to close that option was no longer available. This was especially troubling because before the pandemic she had to deal with one of the downsides of being a freelancer, not knowing when you are going to get your next paycheck or making enough money to keep a roof over her head. Her financial situation was so bad that she had to apply for $10,000 of Economic Injury Disaster Loans. The effects of COVID19 didn't end there because many other freelancers applied for the same loan which caused the Unemployment safety net systems of many states to be overwhelmed by the number of freelancers and employees applying for unemployment. As a result, the $10,000 loan shrank to $1,000 and what didn’t help was that the application website kept crashing. Luckily she managed to get the loans she needed and started using Patreon (a crowdfunding website) to supplement her income along with help from Pandemic Unemployment Assistance. However, she is still she is still struggling to make the same amount of income that she did before the COVID19 Pandemic. Her story is one of the millions of other freelancers (also employees) who were affected by the COVID19 pandemic who are struggling both financially and psychologically. (Castillo) And finally, I also have a question about the study the you mentioned when you said, ”According to a McKinsey study, nearly 80% of gig workers say they’re happier than those working traditional jobs.” Where did you find the study? I tried to look for the study you mentioned conducted by McKinsey Co and I couldn't find the article in the Facts and Sources section on the PragerU website and I only found one article that talked about freelancers on the McKinsey Co website and they didn't even compare and contrast the happiness of employees and freelancers (see sources used for research) Thank you for reading my message. Funny that AB5 was spearheaded by a former Union Leader. Since most of the unions out lived their usefulness they try to make others get under their thumb. Law Enforcement, Fire Fighters, Truckers all need a union to help. Why don't the unions operate on a contract basis, where if there is 1 issue that everyone wants changed they band together hire a union rep(sort of like a lawyer) and split the cost equally according to pay grade.

I'm sure the main proponent of AB5, Ms Gonzales has a big heart but she doesn't understand how business really works. If we elected legislators with businesses experience, the CA assembly would quickly recognize it as a stupid idea and prevent it from going forward. Fortunately, Prop 22 is likely to pass in November which will overturn this egregious law.

I have to call BS on this one. Being an independent contractor would be great if we weren't required to pay both individual taxes AND the taxes a business pays at the end of the year. As an employee, I would only be required to pay a little over $500 for the last year I worked. But as an independent contractor? I'd have to pay 8 TIMES that amount because the IRS considers me, a single worker, a business. Nice try tho.

Prop 22 is a grab by Uber and Lyft to continue exploiting their workers. I voted against it, and all the adds for it on MNpost just make me more glad I did. I don't have a car but I would be happy to pay more for a service if the workers were paid and compensated adequetly. If Uber and Lyft leave California, better paid taxi drivers can replace them.

I remember years ago, when I started working a retail job. Apart of my hiring process and training was for me to sit through a 2 hour long training on why unionization is bad. Same vibes as this.

Because AB5 affects workers and businesses in other states as well as California, my guess is the S.Ct. will strike it down as an impermissible restraint on interstate commerce. Writers in California found themselves out of work by their out of state contractors without having even reached the limit imposed by the state just because those companies didn't want to deal with the California punishments if they went over the limit. If that's not restraint of trade, I don't know what is.

This video described my trajectory perfectly. Left a solid 9-5 at a Fortune 500 to freelance. Beat my 9-5 salary within a year. Moved from Oregon to California. AB5 passed and I immediately lost my biggest client. They let go of all California-based contractors. Very fortunate to have been able to transition back to a 9 to 5 but a lot of people aren’t so lucky. AB-5 is terrible policy that destroys livelihoods and entrepreneurial people’s ability to achieve economic freedom. California has made all California-based freelancers that work digitally non-competitive with every other freelancer in the country.

Go Trump. I vote republican but I think it is wrong for uber to have people make money for them but not insure those employees. Exp: Dominos must have workers comp and unemployment insurance on it's drivers. Not uber. All the benefits of drivers without any liability.

The unions are just as exploitive as crony capitalism. The unions want power at the expense of consumers and prevent the hiring of better employees so their own wages rise. The unions use government to achieve their exploitive ends as businesses use government for their own ends.

No mention of the fact that independent contractors have to pay the payroll taxes that employers normally pay, which decreases their actual income by a great deal. My taxes were more than doubled as an independent contractor in Texas.

Why the hell would anyone go after freelancing? Why do these people want to force everyone into being "the same"? Why do they want to mimic the East?? I'm from the East, and most people here are sick and tired of "uniformity, conformity" because ultimately a system of "uniformity" beats you down and keeps you there!! In other words, what was the positive spin they put to the bill, other than the simplistic "It's good for workers" spiel? I'm not really looking for the "libtard" answer. Where can I get the sources for the claims made? I only saw one McKinsey study and it is not in the description. And the rest of the statistics are unsourced by the presenter. Are all of these Prager videos like this?

100% agree. This whole AB5 is only a desperate tax grab attempt in order to force employers to withhold taxes so tax authorities don't have to go after 200k independent contractors individually, only collect the money at one spot at the employers. everything else is just smoke screen.

Actually this legislation is good: By making it harder to do freelancing under the state / banks regulations, it incentivizes freelancing OUTSIDE the state / banks regulations, e.g. using cryptocurrencies and Smart Contracts as medium of exchange and contract definition. As usual, we don't need to move to kill collectivism - it rots by itself.
