Though it is disingenuous when you have a Republican controlled Senate led by Mitch McConnell deny president Obama his Supreme Court canadate nominee judge Gardner. Mitch McConnell stating that the president should not appoint a new Supreme Court nominee during election year, even though there was still 8 months left in the president Obama administration. Where as president Trump is trying to jam his Supreme Court nominee through with just two weeks left until the presidential election. The two issues being are 1. are we truly letting the American people decide who reside in that life time appointment and 2. Amy Barrett holds far right views that are counter to RBG. Possibly unstabling the Supreme Court to the hard right of politics. It's also possible that the president Trump is hedging his bets that if he does lose the presidential election, he can call in the results and sended it to a loaded Supreme Court in his favor challenging the validity of election results. Problem is that in 2016 Mitch McConnell explicitly said, many times, that he's setting a new precedent that justices should not be appointed in an election year, and even said that that precedent should hold for Republican presidents in the future too. It took him only 4 years to "forget" about that "precedent", and I don't know how that action is anything but a mendacious swindle. True, it's not the fault of Trump or some other Republicans, but if Mitch has any honesty in him he would vote "no" on this confirmation like he swore he would.

Little false on the amount of days from nomination/ to election. RBG replaced Byron White (6/28/93) on 8/10/93.. 42 days from Whites departure (not to election)/ 55 days to Nov 3 but wasn't an election year.. Clinton's first year in office. There is nothing similar to the current nomination or Presidents possible last year in office. With that said... Trump has every right to nominate and have confirmed the appointment... and hope he does since we need to protect the constitution above all else. My understanding is that in an election year, if there is a SC vacancy, If the senate is not held by the president's party, the appointment is usually not approved. If the senate is held by the president's party, the appointment is nearly always approved. (of 19 cases, only 2 were not approved and they were both related to LBJ's appointment of Abe Fortas.)
